Patient Consent for AI Scribe

This brief article gives providers suggested language and resources to use when introducing AI Scribe technology to patients. Healthie encourages (and some jurisdictions may require) obtaining consent before starting the video call session utilizing AI Scribe.

Explainer Example for Patients

Depending on your jurisdiction, verbal consent from patients may be sufficient. Here is some suggested language: 


“To provide you with the best care and attention, I am using a tool called AI Scribe that transcribes conversations and helps with my notes. Your information is private and I will review the content for accuracy. You can tell me to stop using it at any time. Do I have your permission to use this tool during our visits?”


AI Scribe is a HIPAA-compliant platform that helps you and your provider measure progress throughout treatment and make adjustments to treatment as needed. Healthie respects the privacy of all users and will never sell any personally identifiable data.

Common Questions From Patients

Here are some common questions from patients regarding AI transcription services, and some suggested responses as you navigate implementing AI scribe into your practice. 


Am I required to give my consent? What happens if I say no?

Your consent is critical and you can withdraw it at any time. This service is designed to help me focus on you during our visits instead of writing notes, but if you choose not to it will not negatively impact your care.


Are the audio recordings saved?

Audio recordings are temporarily saved in a secure manner until notes are reviewed for quality and accuracy. Recordings are deleted from my account and not stored indefinitely. 

A note on recordings: 

If you are paying for Cloud Recording, it will be at the discretion of the provider to delete recordings. If you are using AI Scribe and not paying for Cloud Recording, Healthie will automatically delete recordings on the back-end for storage and privacy purposes  

Is my information safe?

Your information is protected by law under HIPAA and secured using encryption technology.


Where is my data saved?

AI Scribe fully complies with HIPAA regulations. As part of Healthie’s HIPAA-compliant platform, AI Scribe leverages HIPAA-compliant Zoom to generate draft charting notes securely. These notes are stored directly within your client profile in Healthie, ensuring all protected health information (PHI) remains secure and never leaves the platform.


Can I see the charting note generated by AI Scribe?

I can share this with you the same way I share notes with you post-session. 


Who has access to my data through AI Scribe?

Under HIPAA, your protected health information can only be used for treatment, payment, and healthcare operations, unless you request that I share it with someone else (like a family member).


Can I request to have my information deleted?

Recordings are automatically deleted from the system. The charting note generated from our session is reviewed and modified by me before being securely stored in your client records. For legal and billing purposes, I am required to retain charting notes as part of your medical documentation. Therefore, charting notes cannot be deleted. Let me know if you have any concerns about your records.


How accurate is this technology?

AI Scribe uses advanced AI technology to generate accurate transcriptions and generate charting notes. As your provider, I am still responsible for reviewing the content for accuracy and completeness.
